Why this question matters
An end date does not answer every question about commission. An earlier agency may have introduced a buyer who returns later, or the old agreement may continue in another form. Before you change agencies, put the previous documents and buyer records beside the proposed new agreement. Ask both agencies to explain how they will avoid conflicting expectations.
What to ask the agent for
The introduction and continuing-commission clauses, how introduced buyers are recorded, and how the agency reduces double-commission risk.
Ask your lawyer or conveyancer to assess the handover before signing a new agreement or accepting an offer from a previously introduced buyer. Keep written confirmation of termination and the relevant correspondence with each agency.
What a strong answer should include
Explains the clause in plain English and documents introduced buyers clearly.
What to write down or compare
- The clause governing introduced buyers and any continuing entitlement.
- The names and introduction records provided when the old agreement ends.
- Any continuing general agency, notice period or overlap with the proposed new agreement.
Relevant NZ seller considerations
REA says an agency cancelling an agreement must identify potential buyers it introduced and explain that a later purchase may result in commission. Do not assume a single continuing-commission time limit applies to every agreement.

Question eleven: Could I still owe commission after the agreement ends? Possibly. An end date does not always end every commission obligation. A previous agency may have introduced a buyer who returns later, or another clause may continue after the campaign finishes. Ask the agent to show you the exact clause, explain the dates that apply, and identify how introduced buyers will be recorded when the agreement ends. Keep written confirmation of cancellation and any buyer list the agency provides. Before appointing another agency, accepting an offer from a previously introduced buyer, or selling privately, ask your lawyer or conveyancer to check the handover. Do not assume one time limit applies to every agreement. A strong answer is specific to the written contract and explains how overlapping commission claims will be avoided.
